Terms of Service

These Terms of Service (“Terms”) govern your use of the National Telemedicine Doctors (“we”, “our”, “us”) website and telehealth services. By booking or attending an appointment, you acknowledge that you have read, understood, and agree to these Terms.

1. Our Service

National Telemedicine Doctors provides video telehealth consultations with Australian registered General Practitioners (GPs) for urgent but non-emergency medical conditions.

Our doctors are registered with the Australian Health Practitioner Regulation Agency (AHPRA) and provide services in accordance with applicable Australian laws and professional standards.

2. Eligibility

By booking an appointment, you confirm that:

  • You are located in Australia during the consultation.
  • You are providing accurate and complete personal information.
  • You have the legal capacity to consent to medical treatment.
  • If booking for a child or another person, you have lawful authority to do so.

3. Nature of Telehealth

You acknowledge that:

  • Telehealth consultations are conducted by secure video.
  • A physical examination is limited or not possible.
  • Your doctor may determine that telehealth is not clinically appropriate.
  • Your doctor may recommend an in-person examination, attendance at a local medical practice, or referral to a hospital.

Medical advice is based on the information you provide. Incomplete or inaccurate information may affect your diagnosis or treatment.

4. Emergency Medical Conditions

Our service is not an emergency service.

Do not use National Telemedicine Doctors for:

  • chest pain
  • severe difficulty breathing
  • stroke symptoms
  • severe allergic reactions
  • major trauma
  • seizures
  • loss of consciousness
  • suicidal thoughts or other psychiatric emergencies
  • any condition that requires immediate emergency assessment.

If you believe you are experiencing a medical emergency, call 000 immediately or attend your nearest Emergency Department.

5. Appropriate Use

Our service is intended for urgent, non-emergency healthcare including, where clinically appropriate:

  • acute illnesses
  • infections
  • skin conditions
  • medication advice
  • medical certificates
  • referrals
  • pathology requests
  • imaging requests
  • repeat prescriptions where clinically appropriate.

The treating GP retains complete clinical discretion regarding diagnosis, investigations, prescriptions, referrals and treatment.

Booking an appointment does not guarantee that:

  • medication will be prescribed;
  • a referral will be issued;
  • a medical certificate will be provided; or
  • a requested treatment will be approved.

6. Medicare Billing and Patient Consent

Where you are eligible for Medicare benefits, you consent to National Telemedicine Doctors submitting a Medicare claim on your behalf for the telehealth consultation.

By proceeding with your appointment, you:

  • assign the relevant Medicare benefit to the treating practitioner;
  • authorise us to submit claims to Medicare on your behalf;
  • consent to us billing the applicable Medicare Benefits Schedule (MBS) telehealth item;
  • acknowledge that your Medicare details may be used for claiming purposes.

You declare that the information provided is accurate and that you satisfy Medicare eligibility requirements.

If Medicare benefits are unavailable, rejected, or later recovered by Services Australia due to incorrect eligibility or information provided by you, you agree to pay any outstanding consultation fee.

Nothing in these Terms guarantees that Medicare will pay any benefit.

7. Clinical Decision-Making

The treating GP exercises independent professional judgment.

Doctors may decline to provide:

  • prescriptions;
  • referrals;
  • pathology requests;
  • imaging requests;
  • medical certificates; or
  • any treatment considered clinically inappropriate.

8. Prescriptions

Where clinically appropriate, prescriptions may be issued electronically.

Certain medications, including Schedule 8 medicines, drugs of dependence and other restricted medicines, may not be prescribed through our telehealth service.

9. Medical Records

We maintain medical records in accordance with Australian legal and professional obligations.

Information may be shared with:

  • your nominated GP;
  • specialists;
  • hospitals;
  • pharmacies;
  • pathology providers;
  • radiology providers;

where clinically necessary or where required by law.

10. Privacy

We collect, use and disclose personal and health information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and applicable health records legislation.

By using our service, you consent to the collection, storage and use of your information for:

  • providing healthcare;
  • Medicare billing;
  • communicating with you;
  • quality assurance;
  • legal and regulatory compliance.

11. Technology

You are responsible for ensuring you have:

  • a suitable device;
  • internet access;
  • a functioning camera and microphone; and
  • a private location suitable for a medical consultation.

We are not liable for interruptions caused by internet outages, device failures or third-party technology providers.

12. Appointment Times

Appointment times are estimates only.

Delays may occur due to clinical emergencies or extended consultations.

We will make reasonable efforts to provide consultations as close as possible to the scheduled time.

13. Cancellation and Missed Appointments

If you are unavailable at the scheduled appointment time, the consultation may be cancelled.

Any cancellation or refund policy published on our website forms part of these Terms.

14. Limitation of Liability

To the extent permitted by law:

  • our liability is limited to the resupply of services or the cost of resupplying services;
  • we are not liable for indirect or consequential loss;
  • we are not responsible for clinical outcomes arising from inaccurate or incomplete information supplied by you;
  • we are not liable where you fail to follow medical advice or seek recommended emergency or in-person care.

Nothing in these Terms excludes any rights that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

15. Intellectual Property

All website content, branding, logos and materials remain the property of National Telemedicine Doctors unless otherwise stated.

16. Changes to these Terms

We may update these Terms from time to time.

The current version published on our website applies from the date it is published.

17. Governing Law

These Terms are governed by the laws of Australia and, where applicable, the State or Territory in which the healthcare services are provided.
